In this study of Giorgio Agamben's pre-Homo Sacer work, I assess his idea of the ethical subject. Over the course of these early writings, he adopts a Walter Benjamin-inspired redemptive aim as he endeavours to uncover the circumstances of alienated subjectivity and possibility of authentic experience. However, while Agamben borrows from Benjamin to elaborate on the ethical potential of the nihilist pose, a more Kantian conception of idealist autonomy becomes increasingly pronounced. This Kantianism is at odds with the Benjaminian nihilism (...) that guides his redemptive prescription, leaving Agamben's ethical subject mired in a realm of meaningless authenticity. (shrink)

We propose the Prototime Interpretation of quantum mechanics, which claims that quantum entanglement occurs in a "prototemporal" realm which underlies spacetime. Our paper is tentative and exploratory. The argument form is inference to the best explanation. We claim that the Prototime Interpretation (PI) is worthy of further consideration as a superior explanation for perplexing quantum phenomena such as delayed choice, superposition, the wave-particle duality and nonlocality. Despite their ethical challenges, recommender systems (RS) are widely endorsed as a necessary solution to the problem of information overload. After clarifying how the harmful effects of information overload can be characterized in distinct ways, I explore the often overlooked potential benefits of abundant online spaces. I argue that these spaces afford valuable opportunities to experience spontaneous freedom. I then put forth a more comprehensive evaluation of the role RS should assume in algorithmically structuring the online space. This article considers the recent Court of Appeal decision of Bank of Credit and Commerce International (Overseas) Ltd v Akindele. In this case, the Court of Appeal was required to consider a claim that the defendant should be held liable as a constructive trustee for dishonestly assisting in breaches of fiduciary duty, or knowingly receiving property traceable to a breach of fiduciary duty. The decision is important as the Court of Appeal proposed a new liability test for the claim of (...) knowing receipt. It was held that the test should no longer be based on knowledge. Instead, the court should now determine the claim on the basis of whether the defendant received the property unconscientiously. This article reviews the law, and suggests that the test of unconscientious receipt is preferable to the test of knowledge, as it has a flexibility which was not available under the knowledge‐based test. But, the notion of unconscientiousness, or unconscionability, is too subjective and requires some structure. In the article, economic analysis is used to give the concept of unconscionability the necessary structure. (shrink)

Both bioethics and law have governed human genomics by distinguishing research from clinical practice. Yet the rise of translational genomics now makes this traditional dichotomy inadequate. This paper pioneers a new approach to the ethics of translational genomics. It maps the full range of ethical approaches needed, proposes a “layered” approach to determining the ethics framework for projects combining research and clinical care, and clarifies the key role that return of results can play in advancing translation.

This study investigates the effectiveness of pedagogical practices used to teach business ethics. The business community has greatly increased its demands for better ethics education in business programs. Educators have generally agreed that the ethical principles of business people have declined. It is important, then, to examine how common methods of instruction used in business ethics could contribute to the development of higher levels of moral judgment competence for students. To determine the effectiveness of these methods, moral judgment competence levels (...) for undergraduate and graduate students from three institutions were measured and compared based upon the pedagogical method used in a business class. Significant differences were found for moral reasoning and moral competence scores depending on the method used for ethics instruction. Students in classes with more highly integrated ethics coverage scored higher in moral reasoning and moral competence. (shrink)

In February 2000, the EuropeanCommission adopted a Communication on theprecautionary principle. This states how theCommission intends to apply the principle andestablishes guidelines for its application. Thedocument is intended to inform discussions oninternational agreements. In particular, itprovides a defense of European Union (EU)precautionary policies in case of tradedisputes, for example, in case the EU isaccused of imposing unfair trade barriers onexports of genetically-modified (GM) productsfrom the United States under the rules of theWorld Trade Organisation. In the communication,the Commission emphasizes the scientificaspects (...) of the precautionary principle, perhapspartly to counter claims from US officials thatthe EU's reluctance to accept GM imports is notbased on science but is politically-motivated.However, a principle is by definition a moralguide to behavior. In other words, it is anethic. The precautionary principle should beviewed as a complement to science, to beinvoked when a lack of scientific evidencemeans that outcomes are uncertain. Anyinterpretation of this principle needs to placeat least as much emphasis on its ethical andvalue-based aspects as on its scientificjustification. The Commission's interpretationrisks undermining the painstaking progress madeamong European Union member states inresponding to public concern about GM crops andfood by adopting increased precaution. Thispaper explores the balance between thescientific and ethical/value-based aspects ofthe precautionary principle as set out in theCommission's communication, to make the casethat it is the ethical and value-based aspectsrather than the scientific aspects of theguidelines that need strengthening. The social discount rate – the rate at which future benefit flows from government investment are discounted to present value – has been a frequent subject of technical debate among professional economists. From a broader perspective, however, the selection of an appropriate rate enjoins consideration of questions that define the very contours of our public philosophy. It carries implicit assumptions about the nature of citizenship, the relation between public and private spheres, and, most singularly, the status of a political society (...) as it is located in time. A key determinant of intertemporal economic allocation, the social discount rate provides a unique registry of a polity's historical consciousness and perceptions of its intergenerational obligations. Yet the highly technical nature of the debate over the discount rate has proven inhospitable to scholars otherwise inclined to investigate its ethical dimensions. Some, notably A. K. Sen, have begun to address these philosophical issues, though much territory remains to be explored. (shrink)

The paper builds an argument about empathy, kinesthesia, choreography, and power as they were constituted in early eighteenth century France. It examines the conditions under which one body could claim to know what another body was feeling, using two sets of documents – philosophical examinations of perception and kinesthesia by Condillac and notations of dances published by Feuillet. Reading these documents intertextually, I postulate a kind of corporeal episteme that grounds how the body is constructed. Disneyland is work disguised as play; school disguised as vacation. While Walt Disney’s curriculum deploys across all of its products, it literally engulfs the approximately 50 million ‘guests’ who visit the Disney Parks each year. Drawing on Sarah Ahmed’s phenomenological reading of orientation in Queer phenomenology, this article investigates the ways in which Disney’s didacticism is made material through practices and procedures designed to orient the park’s visitors, to ensure that those visitors always know where they are and who they (...) are, as a means of educating ‘good’ citizens. The argument focuses not on Disneyland’s narrative curriculum but on its corporeal one: visitors are enticed to make affective investments, to construct or reconstruct their identities to comply with the Disney version of the ideal American worker and consumer, as the park attempts to reorient those who resist those roles. In an analysis of 47 U.S. journalism ethics codes, we found that although most consider images, only 9 address a gripping issue: how to treat images of tragedy and violence, such as those produced on the battlefields of Iraq, during the 2005 London bombings, and after Hurricane Katrina. Among codes that consider violent and tragic images, there is agreement on what images are problematic and a move toward green-light considerations of ethical responsibilities. However, the special problems of violence and truth (...) telling in wartime and issues of how to handle graphic images across media platforms receive virtually no attention. (shrink)

Sixty-five computer science and computer information systems students were surveyed to ascertain their ethical beliefs on seven scenarios and nineteen ethical problems. All seven scenarios incorporated computer-related problems facing programmers and managers in the high tech world. Hypotheses were tested for significant differences between the students'' beliefs and the beliefs of experts in the field who responded to the same scenarios. The first two hypothesis tested whether female and male high tech students have the same ethical beliefs as the experts (...) who first examined these scenarios. The female students did not agree with the experts in seven of the nineteen problems while the male students did not agree with the experts in eight of the nineteen problems. Both computer information systems and computer science majors disagreed with the experts in ten cases. The last three hypotheses tested whether students from different income levels agreed with the experts. All three groups disagreed significantly with the experts on eight problems. (shrink)

Because moral perception plays an essential role in guiding morally responsible behaviour, agents have a responsibility to develop their capacities in this area. There are several strategies agents can (and should) pursue in order to improve their skills at moral perception. I appeal to insights derived from the work of feminist epistomologists and philosophers of science to argue that feminist approaches to multiculturalism are particularly valuable tools for improving moral perception.
